Flaig; Ryan Keith; Christine Rinehart Subject: Re: YWD Sketch Plan Review - North Yarmouth Booster Pump Station Categories: Planning Board Hi Tracey, I had some trouble tracking down the deed for the lot you questioned earlier so I had our legal counsel look into it and he verified that the Yarmouth Water District owns the corner lot. I copied his email below. I believe we will provide copies of the deeds with the site plan application. Please let us know if you have any other questions. ---- Eric, Dan, In support of the Yarmouth Water District’s application for land use approvals from the Town of North Yarmouth and to demonstrate the District’s right, title and interest in the property proposed to be used for this project, below please find a summary of the deeds from which the Yarmouth Water District derives its title to Map 8, Lots 29-31. Map 8, Lot 29: Deed from Eleanor H. Hays to the Yarmouth Water District dated December 26, 1942 and recorded in the Cumberland County Registry of Deeds in Book 1704, Page 368. The parcel of land conveyed to the Yarmouth Water District pursuant to this deed is larger than this tax parcel; much of the land conveyed by this deed also makes up a portion of Map 8, Lot 30. Map 8, Lot 30: The Yarmouth Water District derives its title to this tax parcel from several deeds. As mentioned above, a portion of this parcel is described in the deed from Eleanor H. Hayes recorded in Book 1704, Page 368. Another portion of this parcel is described in a deed from Edward G. Hayes dated October 4, 1905 and recorded in Book 773, Page 393. Another portion of this parcel is described in a deed from Gertrude L. Cole dated November 22, 1905 and recorded in Book 776, Page 337. Another portion of this parcel is described in a deed from Edward G. Hayes dated March 11, 1907 and recorded in Book 821, Page 433. Another portion of this parcel is described in a deed from Gertrude L. Cole dated October 24, 1922 and recorded in Book 1118, Page 412. Map 8, Lot 31: The Yarmouth Water District derives its title to this tax parcel pursuant to a deed from Robert R. Curry dated April 11, 1986 and recorded in Book 7132, Page 20. This deed includes the fee simple interest to the strip of land on the southeast side of Route 9 labelled Maine Central Railroad on the tax map that separates Map 8, Lot 29 and Map 8, Lot 30. Railroad Strip Chain of Title: Jonathan P. Rowe conveyed this strip of land to the Maine Central Railroad Company by a deed dated September 22, 1870 and recorded in Book 381, Page 197. The Maine Central Railroad Company then conveyed the strip to Harry B. Ripley by deed dated February 18, 1975 and recorded in Book 3763, Page 260. Harry P. Ripley and Ruth C. Ripley conveyed the strip of land to Robert R. Curry by deed dated March 9, 1984 and recorded in Book 6416, Page 23. Robert R. Curry conveyed the strip to the Yarmouth Water District by deed dated April 11, 1986 and recorded in Book 7132, Page 20. Please let me know if you have any questions about this matter.
